These Water Delivery Terms of Service ("Terms") govern the provision of all goods and services by Le Bleu of Cayman Ltd., a company incorporated in the Cayman Islands ("Company", "we", "us", or "our"), to any individual or entity ("Customer", "you", or "your") who orders, receives, or pays for the Company's products or services.
By doing any of the following, you confirm that you have read, understood, and agree to be bound by these Terms in full:
If you do not agree to these Terms, you must not use our services or accept our products. Where an authorised representative accepts these Terms on behalf of a company or other legal entity, that representative warrants that they have authority to bind that entity.
The version of these Terms in force at the time of each order governs that transaction. The current version is always available at www.lebleu.ky/terms. We recommend that you save or print a copy for your records.
The Company supplies ultra-pure bottled drinking water in five-gallon bottles ("Bottles") and related delivery services to residential, commercial, and marine customers throughout the Cayman Islands.
The Company may also supply, from time to time, replacement parts and accessories, cleaning and sanitisation services, and other products and services. All such goods and services are subject to these Terms unless a separate written agreement is provided. Water cooler and dispenser units (whether on a rental or purchase basis) are not supplied under these Terms and are governed by a separate written equipment agreement between the Company and the Customer. Current pricing for all products and services is available at www.lebleu.ky (unless agreed otherwise in writing) and may be updated from time to time in accordance with Section 5.
Delivery services are available within the Company's current service area. The Company reserves the right to decline orders or deliveries outside its operational area at its sole discretion.
Prices for all products and services, including five-gallon bottles of water, are as published on the Company's website at www.lebleu.ky or as quoted in writing at the time of order. Prices may be updated from time to time in accordance with Section 5.
All prices are quoted in Cayman Islands Dollars (CI$) unless otherwise stated. The Company also accepts United States Dollars (US$) at the prevailing exchange rate of CI$1.00 : US$1.25. The Company reserves the right to adjust the accepted exchange rate with reasonable notice.
Payment is due in full at the time of delivery unless the Customer has an approved credit account. Approved credit account holders must settle all invoices on or before the fifteenth (15th) day of the month following the month in which the invoice is issued. The Company reserves the right to withdraw credit facilities at any time by written notice.
Any query or dispute relating to an invoice must be raised in writing with the Company within thirty (30) days of the invoice due date, setting out the disputed item(s) and the grounds for dispute. Invoices not disputed within that period shall be deemed accepted by the Customer as accurate and payable in full, and the Customer shall have no further right to dispute or set off against those invoiced amounts. Raising a dispute does not suspend the Customer's obligation to pay any undisputed portion of the invoice by the due date.

If payment is not received when due, all outstanding amounts become immediately payable. The Company may suspend deliveries without further notice. The Customer shall be liable for all reasonable costs incurred in recovering unpaid amounts, including collection agency fees, administrative charges, court filing fees, and reasonable legal fees. Interest may be charged on overdue balances at a rate of 1.5% per month (or such other rate as permitted under applicable Cayman Islands law) from the due date until the date of full payment.
A refundable deposit is charged for each five-gallon bottle issued to the Customer at the then-current rate published on the Company's website at www.lebleu.ky, or as otherwise notified in writing. The deposit is separate from the price of the water and will be itemised on the Customer's delivery receipt or invoice.
Where additional bottles are supplied after the commencement of a customer relationship, the deposit applicable to those additional bottles shall be the then-current deposit rate as determined by the Company at the time of supply, regardless of any prior deposit rate paid. The Company will publish the current deposit rate on its website, and the deposit rate applicable to any bottle supplied is the rate published or quoted in writing at the time of supply.
Bottle deposits are fully refundable subject to the following conditions being met:
Refunds will be processed within five (5) business days of the bottle's return and verification of the above conditions, using the same payment method as the original deposit where practicable. The Company reserves the right to apply deposit amounts toward any outstanding balance on the Customer's account.
A deposit will not be refunded, in whole or in part, where a bottle:
Bottles not returned within thirty (30) days of account closure, termination of service, or a written request to cease deliveries will be deemed lost. The Company may retain the full deposit for deemed-lost bottles and may invoice the Customer for any shortfall between the deposit held and the current replacement cost of the bottle.
All bottles and Company equipment remain the sole and exclusive property of Le Bleu of Cayman Ltd at all times. Customers must not sell, lend, pledge, transfer, alter, or otherwise dispose of Company property. The Company reserves the right to recover its property wherever these Terms are breached or the customer relationship is terminated.
The Company may adjust the price of its five-gallon bottled water product, and the associated bottle deposit, only upon thirty (30) days' written notice. Notice will be given by email to the Customer's registered email address, by a notice on the Company's website, or by written delivery note. Continued acceptance of deliveries after the notice period constitutes acceptance of the revised pricing.
All other goods and services supplied under these Terms — including, without limitation, bottle deposits, replacement parts and accessories, cleaning and sanitisation services, and any other ancillary goods or services — are supplied on an order-by-order basis and may be amended by the Company at any time and without prior notice. The price (or, in the case of bottle deposits, the deposit amount) applicable to any such item is the price or amount published on the Company's website at www.lebleu.ky or quoted in writing at the time the relevant order is placed, and placing an order constitutes acceptance of that price or amount. Water cooler and dispenser units (whether on a rental or purchase basis) are not supplied under these Terms and are governed by a separate written equipment agreement.
The Company reserves the right to update these Terms at any time. Material changes will be communicated to registered customers by email at least thirty (30) days before the effective date of the change. The updated Terms will also be published on the Company's website with the new effective date and version number. Customers who continue to use the Company's services after the new Terms take effect will be deemed to have accepted the updated Terms.
These Terms establish a rolling, month-to-month service arrangement with no fixed minimum term, unless the Customer has entered into a separate written agreement specifying a fixed term.
Either party may terminate the service arrangement by giving the other party not less than fourteen (14) days' written notice. Notice may be given by email, post, or in person at the Company's premises.
Upon termination, the Customer must:
Refundable deposits (if any) will be returned after deduction for missing or damaged bottles, any unpaid balances, and any other amounts owed to the Company, within five (5) business days of all bottles and equipment being returned and accounts being settled.
The Company may terminate service immediately and without notice where the Customer is in material breach of these Terms, including but not limited to non-payment, misuse of Company property, or providing false account information.

Deliveries will, as a matter of course, be left at the delivery address whether or not an authorised person is present, in such location at the delivery address as the Company's delivery personnel reasonably determine to be suitable. The Company may, in its sole discretion and without obligation, instead leave the delivery in an alternative safe and accessible location or return the order to its facility — for example, where the delivery personnel are unable to gain safe access to the address, or where leaving the delivery at the address would in their reasonable judgement be unsafe. The Customer acknowledges that risk of loss in products left at the delivery address passes to the Customer on delivery in accordance with Section 9.1, and the Company accepts no liability for loss of, damage to, or interference with products so left.
A special delivery fee, at the then-current rate published on the Company's website at www.lebleu.ky or as otherwise notified in writing, may be charged where:
The Customer is responsible for keeping their account information — including delivery address, contact details, and email address — accurate and up to date. The Company accepts no liability for failed deliveries, missed notices, or other consequences resulting from outdated account information.
The Company is committed to resolving product and service concerns promptly. If you have a complaint or quality concern, please follow these steps:
Complaints raised more than 7 days after delivery may not be eligible for replacement or credit.
Risk of loss or damage to bottles and equipment transfers to the Customer upon delivery and remains with the Customer until the bottles or equipment are collected by or physically returned to the Company.
To the fullest extent permitted by the laws of the Cayman Islands, the Company shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from the supply or use of its products or services, including but not limited to loss of business, loss of profit, or damage to property caused by improper use or storage of bottles. The Company's total liability to the Customer in connection with any single event or series of related events shall not exceed the total value of the relevant order.
The Company shall not be liable for any failure or delay in the performance of its obligations caused by circumstances beyond its reasonable control, including but not limited to: hurricanes, tropical storms, flooding, or other severe weather events; acts of God or natural disasters; governmental orders, restrictions, or actions; power or utility failures; supply chain disruption; strikes or labour disputes; or pandemic or epidemic conditions. In such circumstances, the Company will use reasonable endeavours to resume normal service as soon as practicable and will notify affected customers as soon as reasonably possible.
In order to provide our products and services, the Company collects and processes personal data including your name, delivery address, telephone number, and email address. We may also retain transactional records including order history, payment records, and delivery receipts.
We use your personal data to process and fulfil orders, manage your account, communicate with you about your service, and comply with our legal obligations. We do not sell or share your personal data with third parties for marketing purposes.
We retain your personal data for as long as your account is active and for a reasonable period thereafter in accordance with applicable legal requirements. You may request access to, correction of, or deletion of your personal data by contacting us at customerservice@lebleu.ky.

These Terms are governed by and construed in accordance with the laws of the Cayman Islands. In the event of any dispute arising out of or in connection with these Terms or the supply of products and services, the parties agree to first attempt to resolve the matter in good faith through direct negotiation, using the complaints procedure set out in Section 8.1.
If a dispute cannot be resolved through direct negotiation within thirty (30) days (or such longer period as both parties agree in writing), either party may refer the matter to the courts of the Cayman Islands, which shall have exclusive jurisdiction over such disputes.
These Terms, together with any signed account application, equipment rental agreement, or written quotation accepted by both parties, constitute the entire agreement between the Company and the Customer with respect to the supply of products and services. They supersede all prior oral or written discussions, representations, and understandings.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, and all remaining provisions shall continue in full force and effect.
Failure or delay by the Company to enforce any provision of these Terms on any occasion shall not constitute a waiver of that provision or any other right. Any waiver must be given in writing to be effective.
The Customer may not assign or transfer any rights or obligations under these Terms without the prior written consent of the Company. The Company may assign its rights and obligations under these Terms to any successor entity or in connection with a business sale or restructure.
